TERMS AND CONDITIONS FOR Nexa

1. For new connections, connection fee will be determined by Nexa and connection fee is non – refundable.

2. For new connections, connection fee and monthly fee must be paid together.

3. New connections will be operational within 72 hours.

4. Customer must provide an attested photocopy of their National Identification Card (NID) and an attested passport size photograph. Attestation shall be done by the customer.

5. Foreign customers must provide an attested photocopy of their Passport. Attestation shall be done by the customer.

6. For customers under the age of 18, their legal guardians must sign the Customer Information Form.

7. Internet connection may be disconnected for incomplete Customer Information Form or false documents.

8. The monthly fee is prepaid, and billing starts from the day of connection. Monthly fee must be paid within the 7th day of every month. If the bill is not paid within 11:59AM on the 7th day of every month, the internet connection will be automatically disconnected. After the customer pays the due, the connection will restart.

9. Customer will not be entitled to any discount or price waiver if the internet connection remains disconnected for non – payment of bill.

10. The customer shall pay taxes and VAT along with the monthly fee as per the Government rules. No deduction shall be made by the customer.

11. ACE IT Networks Limited reserves the right to change the monthly fee at any time.

12. Monthly fee shall be paid via the payment gateway of SSL Commerz.

13. Customer shall take proper care and maintenance of their computer/device and data. Nexa shall not be responsible for any damage to Customer computer/device and/or theft of data.

14. Customer cannot provide/share/rent/lease the internet connection to any third party. If a customer violates this provision, Nexa reserves the right to impose a fine it deems appropriate.

15. If any equipment or devices of Nexa has been installed within the premises of the customer, the customer shall ensure the security of said equipment or device and shall allow the access of technicians of Nexa to said equipment or device.

16. If the internet connection cable or any device or equipment is damaged by the customer, the customer shall reimburse Nexa.

17. A customer can change their internet package highest once in a month. In this case, no additional charge shall be applicable for that month.

18. If a customer wishes to terminate the internet connection temporarily or permanently, they must inform Nexa by the 25th of the previous month via phone call (09653700700).

19. If any connection remains terminated for more than 01 month, the internet connection shall be terminated permanently. For reconnection, customer shall have to pay a reconnection fee.

20. If an internet connection is terminated without prior notice, the customer shall pay the fee for the entire month.

21. Customer shall not use the internet connection for any activities which is illegal as per the laws of the Government of Bangladesh. Customer shall be solely responsible for such activities.

22. If the customer faces any loss or damage for any disruption in the connection due to unavoidable circumstances or natural disasters, Nexa shall not be responsible. If under such circumstances, there is any delay in re-establishing the connection and for such

delay the customer faces any loss or damage, Nexa shall not be liable. Customer shall also not be entitled to any discount or price reduction.

23. Devices and equipments used for internet connection shall be under the sole ownership of Nexa. Nexa reserves the right to uninstall and take back any such device or equipment if the connection is terminated.

24. For change of location of internet connection, customer shall inform Nexa via phone call (09653700700). Customer shall have to pay connection transfer fee.

25. For any problem in internet connection, customer shall inform Nexa via phone call (09653700700). If the customer is late in informing any problems, Nexa shall not be responsible for any delay in fixing the issue.

26. If there is any issue regarding internet connection, the problem shall be fixed by technicians of Nexa (Seven days a week, 09:00AM to 06:00PM). (BTRC).
